Sun Sues Microsoft Over Java
This week, Sun Microsystems sued Microsoft Corp., claiming the software giant secretly
modified its Internet Java support to break Java's portability. The complaint alleges
Microsoft's Internet Explorer 4.0 browser fails Sun's extensive Java compatibility
tests, and further claims breach of contract, trademark infringement, false advertising,
unfair competition, and interference with prospective economic advantage.
Charles Fitzgerald, Microsoft's group program manager for Java, says IE4 passed Sun's
rigorous test suite in Microsoft's labs, generating 0 failures with its JITC disabled,
and 2 failures with the JITC enabled. Fitzgerald also claims Sun's own Java implementation
for Windows failed up to 45 of the same tests.
John Blumberg, a Philadelphia attorney, says there's one telltale sign that could
indicate how this case will play out in the courtroom. Blumberg says, "Microsoft
believes it has a colorable right to do what it's doing, or it wouldn't do it."
