"Apple's 2nd-Qtr Profit Rises

Ipod, Macintosh Shipments Slow" Isn't that amazing headline from Blooberg? You have to read the article to find out that the shipments slowing refers to drop off from the record holiday quarter. Its second quarter profit actually increased $410 million from $290 year over year and sales increased 34 percent to $4.36 billion over last year. The increase paled with the growth rate that averaged 65 percent in the prior five periods. Read the full story, or listen to the actual Apple conference call.

Next time you feel like you're ISP is ripping you off surf over to this site and be reminded how bad it could be. Of course, I actually wonder where they will find the 10,000 people they think they will get for this site. They only charge about 15 times what AOL does. Apple vs. John Does

Court doesn't appear to be leaning Apple's way -- Last week, the California Appeals court heard arguments concerning Apple's lawsuit against some bloggers who Apple accuses of distributing Trade Secrets over the Internet.
A Santa Clara County Superior Court judge sided with Apple and the Appeals Court is reviewing the case. Two of the three appeals court justices seemed to suggest that Apple had not even shown that serious trade secrets had been revealed.
"You don't really claim this is some sort of new technology, do you?" Presiding Justice Conrad Rushing said to Apple's Riley at one point. The appeals court now has 90 days to rule on the case which will probably wind up in the Supreme Court. (Read More)

Apple the phone company?

Speculation is ramping up once again, that Apple will be setting up its own virtual network in much the same way that Virgin has done. Legal music on the Net besides Apple

According to Jack Kapica at the Globe and Mail, Mercora IMRadio is "about the closest one can come to getting music from Kazaa and still be legal." But it is pretty much a secret. IMRadio pays royalties to the music industry collectives that disburse royalty payments to music artists and it behaves like a radio stations with advertising. Howver, the advertising is displayed on the software, not as audio content.
But it will allow you to search for certain songs or artists, and play them, with certain limitations. Such as the inability to play the same artist more than 3 times in an hour.
The users themselves supply the music library. Also it doesn't provide a way to capture the songs as the play, but they do provide a way to purchase the songs. They are claiming that on average, after 9 hearings of the same song, a user will purchase it. (Read More)
